These Terms of Service ("Terms") govern your use of Kaysid (the "Service"), provided by [COMPANY LEGAL NAME], [REGISTERED ADDRESS] ("we", "us"). By creating an account or using the Service you agree to these Terms, our Acceptable Use Policy and our Privacy Policy. If you use the Service for an organisation, you confirm you may bind it to these Terms.
1. The Service
Kaysid lets you connect your own email mailboxes and send personalised outreach email, manage leads, track engagement and collaborate in workspaces. Messages are sent from mailboxes you connect; you are the sender of every message.
2. Accounts and workspaces
- You must give accurate information, keep your password secure, and be at least 18 years old.
- You are responsible for everything done under your account and in workspaces you own or administer, including by people you invite.
- Workspace owners control membership and roles. Removing a member ends their access to that workspace.
3. Your responsibilities as a sender
- You must have a lawful basis to email every recipient and comply with all laws that apply to you and your recipients, including CAN-SPAM, the GDPR and UK GDPR, PECR, CASL and local anti-spam and data-protection laws.
- You must identify yourself truthfully, include a working unsubscribe mechanism (the Service adds one), and honour opt-outs. Opt-outs are recorded on your workspace suppression list and cannot be reversed.
- You must follow the sending rules of your mailbox providers (for example Google and Microsoft), including their bulk-sender requirements.
- You must not use the Service in breach of the Acceptable Use Policy.
4. Your data
You keep ownership of the content and lead data you upload ("Customer Data"). You grant us the rights needed to host and process it to provide the Service. For personal data in Customer Data you are the controller and we act as your processor, as described in the Privacy Policy. You can export or delete your data at any time; deleting a workspace or your account permanently deletes the associated Customer Data.
5. Plans, limits and fees
The Service is offered on a free plan and may offer paid plans. Each plan has daily sending and seat limits shown in the product. We may change plans or limits with reasonable notice. Paid fees, where applicable, are non-refundable except where required by law.
6. Suspension and termination
We may suspend sending, a workspace or an account immediately if we reasonably believe it breaches these Terms or the Acceptable Use Policy, harms our infrastructure or reputation, or creates legal risk — for example unusually high bounce or complaint rates. You may stop using the Service and delete your account at any time from your profile settings.
7. Third-party services
The Service connects to third-party mail servers and providers (such as Google). Your use of them is governed by their terms, and we are not responsible for them.
8. Disclaimers
The Service is provided "as is". We do not guarantee inbox placement, open rates or uninterrupted availability. To the extent permitted by law we disclaim all implied warranties.
9. Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential losses, and our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim (or USD 100 if you are on the free plan). Nothing limits liability that cannot be limited by law.
10. Indemnity
You will indemnify us against claims arising from the messages you send, the data you upload, or your breach of these Terms or applicable law.
11. Changes
We may update these Terms. We will give notice of material changes by email or in the product; continued use after they take effect means you accept them.
12. Governing law and contact
These Terms are governed by the laws of [GOVERNING LAW / JURISDICTION]. Questions: [LEGAL CONTACT EMAIL].
